What changed:

To further protect your privacy, you no longer need to use Face ID or Touch ID to create an account. All accounts now rely on anonymous IDs, while Face ID and Touch ID remain optional for users who prefer an added layer of privacy.

In addition, all health data from Apple Health (including sleep, steps, energy, flights, exercise, and more) is now stored locally on your device instead of on Google Cloud servers. You can erase all personal data at any time in Settings, or simply by uninstalling the app.

Since certain technical details — such as your anonymous user ID and subscription status — are stored on Google Cloud, please go to Profile → Manage data → Delete account to permanently delete your account.

We designed the Anticipate app to help you understand patterns in your mood and how they may relate to your sleep, activity, and environment. The app offers helpful observations and tips based on your data and what you choose to share. We’re excited for you to give it a try.

Before you get started, please take a moment to read these Terms and Conditions carefully. They explain the legal relationship between you and us when you use Anticipate. If you have any questions, you can contact us — details are in the Questions, Complaints, and Comments section below.

We also take your privacy seriously. Our Privacy Policy explains how we collect, use, and protect your personal data. By using Anticipate, you confirm that you’ve read and accepted these Terms and our Privacy Policy.

1. INTRODUCTION

1.1. These Terms and Conditions (“Terms” or “Agreement”) form a legally binding contract between you and EMOTION SENSE LTD, located at 71–75 Shelton Street, London, England, WC2H 9JQ. Access to and use of our services is subject to your acceptance of these Terms. If you do not agree to them, you won’t be able to use the app or any related services.

1.2. Our services include the Anticipate mobile application (the “App”) and the website at https://helloanticipate.com (the “Website”). Together, we refer to the App and Website as the Services.

1.3. By creating an account, using the App, or accessing any part of the Services, you confirm that you accept and agree to be bound by these Terms. If you do not agree, please do not use the App or Website.

1.4. By agreeing to these Terms, you confirm that:

  • You’ve read and understood them.
  • You agree to use the App only as described here.
  • You won’t use the Services in any way that violates these Terms or any applicable laws.

2. WHO ARE WE?

2.1. Anticipate is developed and operated by EMOTION SENSE LTD, a company registered in the United Kingdom with company number 15603244.

2.2. Throughout these Terms, when we say “we,” “us,” “our,” or “Anticipate,” we’re referring to EMOTION SENSE LTD.

2.3. Our registered office is: 71–75 Shelton Street, London, England, WC2H 9JQ.

3. WHEN DO THESE TERMS APPLY?

3.1. These Terms apply to all use of the Anticipate App, the Anticipate Website, and any related services, features, or content provided by us.

3.2. By using any part of the Services, you are agreeing to follow these Terms.

4. WHO CAN ACCESS ANTICIPATE?

4.1. You must be at least 18 years old to use the Anticipate app and access its content.

4.2. We do not knowingly collect personal data from anyone under the age of 18.

4.3. If you become aware that someone under 18 is using the app, please contact us at team@helloanticipate.com. We’ll take the necessary steps to delete their data and close their account.

5. APP, FEATURES, AND CONTENT ARE NOT INTENDED TO PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT

5.1. THE COMPANY IS NOT A LICENSED MEDICAL CARE PROVIDER AND THE APP IS NOT INTENDED TO REPLACE PROFESSIONAL MEDICAL ADVICE OR DIAGNOSE, TREAT, OR MANAGE ANY ILLNESS OR MEDICAL CONDITION. PLEASE CONSULT WITH A LICENSED PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER BEFORE MAKING ANY DECISIONS OR TAKING ANY ACTIONS THAT MAY AFFECT YOUR HEALTH AND SAFETY. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ IN CONNECTION WITH THE APP. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL EMERGENCY SERVICES IMMEDIATELY.

5.2. ANTICIPATE IS NOT REGULATED OR APPROVED BY ANY HEALTH AUTHORITY, AND ITS INSIGHTS ARE FOR GENERAL WELLBEING SUPPORT ONLY.

5.3. WE DISCLAIM LIABILITY FOR ANY ERRORS OR OMISSIONS, OR FOR UNINTENDED TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS IN THE PROVIDED MATERIALS.

6. REGISTRATION AND ELIGIBILITY

6.1. You do not need an email address or any other form of authentication that relies on personally identifiable information to use the App. When you first open the App, an anonymous account is automatically created for you.

6.2. Anticipate reserves the right to deny account creation or limit access to certain features at our sole discretion.

6.3. If your device is lost, we will not be able to restore access to your account or recover any data (including health or mood data) previously stored on that device. For your privacy and security, we do not store any personal details, health data, or self-reported information on our servers.

6.4. You can delete your account and all associated data at any time in the app settings. Once completed, this action is permanent and cannot be undone.

7. YOUR USE OF THE APP

7.1. Any content you submit through the App is governed by our Privacy Policy and is stored locally on your device, unless explicitly stated otherwise (for example, technical account details). By using the App, you agree not to use it for any purpose prohibited by these Terms. You are responsible for all activity associated with your account and must comply with all applicable local, national, and international laws and regulations.

7.2. You agree that the following actions are strictly prohibited and constitute a material breach of this Agreement. You SHALL NOT:

7.2.1. resell, rent, lease, loan, sublicense, distribute, or otherwise transfer rights to the App;

7.2.2. modify, reverse engineer, decompile or disassemble the App;

7.2.3. copy, adapt, alter, modify, translate, or create derivative works of the App without the written authorization of the Company;

7.2.4. permit other individuals to use the App, including but not limited to shared use via a network connection, except under the terms of this Agreement;

7.2.5. circumvent or disable any technological features or measures in the App for protection of intellectual property rights;

7.2.6. use the App in an attempt to, or in conjunction with, any device, program, or service designed to circumvent technological measures employed to control access to, or the rights in, a content file or other work protected by the copyright laws of any jurisdiction;

7.2.7. use or access the App to compile data in a manner that is used or usable by a competitive product or service;

7.2.8. use your Account to advertise, solicit, or transmit any commercial advertisements, including chain letters, junk e-mail, or repetitive messages to anyone;

7.2.9. use your Account to engage in any illegal conduct;

7.2.10. upload or transmit any communications that infringe or violate the rights of any party;

7.2.11. upload media of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit, or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with this Agreement, and the Company’s Privacy Policy;

7.2.12. upload any material that contains software viruses or any other computer code, files, or programs that is malicious, technologically harmful, or designed to interrupt, destroy or limit the functionality of any computer software, website, or the App;

7.2.13. use the App to diagnose, treat, or mitigate any health conditions;

7.2.14. use the App in any way that interferes with, disrupts, damages, or gains unauthorized access to our servers, networks, or other users’ data.

7.3. Any use of the App that violates these Terms will immediately revoke your license to use the App. Your access is conditional on compliance with this Agreement, and if you breach these terms, your right to use the App will be terminated.

8. LIMITED LICENSE TO THE APP

8.1. We grant you a personal, worldwide, revocable, non-transferable, and non-exclusive license to access and use the App for your own personal, non-commercial purposes — as long as you follow these Terms. You may not copy, store, modify, distribute, transmit, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content (including text, graphics, logos, icons, images, software, or code) from the App without our prior written permission. You also agree not to use any content from the App in publications, in public performances, on websites other than Anticipate, in connection with products or services not offered by us, in any way that could confuse users, damage our reputation, or infringe intellectual property rights.

8.2. All rights, title, and interest in and to the App — except where expressly granted in this Agreement — are reserved by us. If you wish to use any of our trademarks, logos, service marks, or other brand elements, you must request written permission from us by contacting team@helloanticipate.com.

8.3. For clarity: EMOTION SENSE LTD owns all content created and made available in connection with the App — including text, images, audio, video, design, visual elements, interactive features, software code, and data compilations (excluding User Content). This content is referred to as the “Company’s Content.” Unless stated otherwise, we do not grant any rights to this content, and all rights remain with us. You retain ownership of any content you submit (such as mood entries or journal logs). We do not store it on our servers. We do not claim ownership of your health and self-reported data.

9. USE AT YOUR OWN RISK

9.1. Anticipate is designed to help you better understand patterns in your mood and mental wellbeing, based on your health and environment data and the information you choose to share. While we aim to offer helpful insights, we cannot guarantee any specific health-related outcomes or improvements.

9.2. Your use of the App — and any information, predictions, or suggestions it provides — is entirely at your own risk. We make no guarantees regarding the accuracy, completeness, or reliability of any data, analysis, or estimates shown in the App.

9.3. The App is not intended to serve as a medical or scientific tool, or as a substitute for care provided by a healthcare professional.

10. SUBSCRIPTIONS AND BILLING

10.1. Anticipate offers subscription plans that unlock access to features — including personalized insights and other tools — beyond a 7-day free trial. A paid subscription is required to continue using the app after the trial period. By starting a subscription, you agree to the terms set out in this section and authorize ongoing billing until you cancel.

10.2. All subscriptions automatically renew at the end of the free trial or each billing cycle unless cancelled at least 24 hours before the end of the current period. Auto-renewal remains active even if you are not using the App. You are responsible for managing and cancelling your subscription if you no longer wish to be charged.

10.3. If you purchase a subscription through the Apple App Store, payment will be charged to your Apple account upon confirmation. Subscriptions renew automatically at the start of each new billing cycle, and the applicable fee will be charged to the same payment method unless updated. By subscribing, you authorize us to charge subscription fees through your App Store account.

10.4. You may manage or cancel your subscription at any time via your Apple account settings. To avoid being charged for the next period, cancellation must be completed at least 24 hours before the current subscription period ends. 10.5. Deleting the Anticipate App does not cancel your subscription. You must cancel it through your Apple account settings to avoid further charges.

10.6. All payments and refund requests for subscriptions purchased through the Apple App Store are handled by Apple. We are not able to process refunds directly. Please refer to Apple’s refund process here: https://support.apple.com/en-gb/118223.

10.7. We may occasionally update our subscription plans or fees. Any price changes will be communicated to you in advance. Unless you cancel your subscription before the new pricing takes effect, your continued use of the App after the price change constitutes your agreement to the new price.

10.8. Taxes and other applicable charges are based on your billing address and current local tax laws at the time of purchase. If those laws change, your total subscription price may be updated automatically.

10.9. We are not responsible for delays, rejections, or pricing errors caused by the Apple App Store or related billing systems. If a payment issue occurs, please contact Apple directly.

11. JURISDICTION

11.1. These Terms and Conditions are governed by the laws of the United Kingdom. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.

11.2. Some features of the App may not be available in all countries. By using the App, you confirm that you use or access it in compliance with local laws and regulations in your country of residence.

12.2. We’re committed to respectful, kind, and safe communication — and we expect the same in return. If any communication becomes abusive, threatening, or discriminatory, we may restrict your access to support or suspend your account to protect our team and users. If your behavior poses a risk to our team, users, or business, we may suspend your account and escalate the matter to the appropriate authorities.
